    Im RND-Interview erklärt Jugendrichter Andreas Müller, warum das Cannabis-Verbot gegen das Grundgesetz verstoße. Die Kriminalisierung habe Menschen in den Knast gebracht und Familien zerstört. Deshalb setzte er sich für die Legalisierung der Droge ein.
    Herr Müller, Sie haben vor dem Bundesverfassungsgericht für die Legalisierung von Cannabis geklagt. Was soll das?
    Ich habe einen Eid auf das Grundgesetz geschworen und bin nunmehr zur festen Überzeugung gekommen, dass die Cannabis-Kriminalisierung mit der Verfassung nicht mehr in Einklang zu bringen ist. Sie verstößt gegen das allgemeine Persönlichkeitsrecht, gegen die Freiheitsrechte der Bürger und in Bezug auf Alkohol gegen den Gleichheitsgrundsatz. Wir haben über die Jahrzehnte bald über eine halbe Million überwiegend junger Menschen in den Knast gebracht, Millionen ordentlicher Bürger zu Geldstrafen verurteilt und sie stigmatisiert und dadurch auch Familien zerstört.
    Welche Probleme sehen Sie als Richter in der Strafverfolgung?
    Im vergangenen Jahr gab es etwa 220.000 Ermittlungsverfahren im Zusammenhang mit Cannabis. Eine Vielzahl der Fälle wird eingestellt – da arbeiten Polizei und Staatsanwaltschaft für den Papierkorb. Dieses Personal könnte man nutzen, um wirkliche Straftäter zu verfolgen. Für den Staat würden sich bei einer Legalisierung hochgerechnet Einsparungen und zusätzlich Steuern in Höhe von weit über drei Milliarden Euro jährlich ergeben.
    Wie wollen Sie das Verbot kippen?
    Nachdem ich vergangene Woche drei Cannabis-Fälle auf der Liste hatte, habe ich bei zwei Verfahren das Bundesverfassungsgericht angerufen. Ich glaube, dass viele Millionen Menschen darauf hoffen, dass sich das Gericht der Sache annimmt.
    Es ist nicht ihr erster Versuch, auf rechtlichem Weg eine Legalisierung der Droge zu erreichen. Bereits vor 17 Jahren haben Sie beim höchsten Gericht einen Versuch unternommen.
    Das aktuelle Gesetz hatte mal das Ziel, den Cannabis-Konsum zu beschränken. Das ist, wie jeder weiß, nicht eingetroffen. Angesichts der heutigen Kenntnis über die Gefahren von Cannabis halte ich die Kriminalisierung zudem für nicht mehr erforderlich und auch nicht geeignet. Cannabis ist eines der Suchtmittel mit den geringsten Folgen, weit hinter Nikotin und Alkohol. Der Staat schießt bei der bestehenden Gesetzeslage mit Kanonen auf Spatzen. Wir haben keinen Grund mehr, anders zu agieren als in vielen Staaten der USA, in Kanada, den Niederlanden und vielen weiteren Staaten, die es in den letzten Jahren mit einer Legalisierung vorgemacht haben.“

    Mittlerweile sind die Zeiten anders: Wir haben Cannabis in der Medizin, bald 50 Prozent der Bevölkerung spricht sich für die Legalisierung aus und es gibt Parteitagsbeschlüsse von FDP, Grünen, Piraten und Linken – sowie eine gespaltene SPD. All das hat das Bundesverfassungsgericht abzuwägen. Und es müsste dann zu dem Schluss kommen, dem Gesetzgeber zu sagen, dass er zumindest Konsumenten nicht mehr verfolgen darf.

    Warum tut sich der Gesetzgeber aus Ihrer Sicht so schwer mit dem Thema Cannabis?
    Die deutsche Politik hat Angst. Bei den Parteien ist sie so tief verwurzelt, dass sie anschließend irgendwelche Stimmen verlieren könnten. Sie haben noch nicht verstanden, dass in der Bevölkerung ganz anders und besser gedacht wird als in ihren eigenen Reihen. Und sie haben vor allen Dingen Angst davor, nicht als Law-and-Order-Partei zu gelten. Ein hartes Vorgehen des Staates hat allerdings noch nie etwas gebracht und bindet Ressourcen ohne Ende. Die Niederlande sind das beste Beispiel: Dort funktioniert es seit 50 Jahren.“
