„Der von Dirk Moses in seinem Buch „The Problems of Genocide“ angestoßene neuerliche „Historikerstreit“ deckt auch außerhalb der Geschichtswissenschaft, nämlich im Völkerrecht, logische und definitorische Schwachstellen auf, die dort bis zu der Frage führen, wie es denn ein „Völkerrecht“ überhaupt geben kann.
In der FAZ (13. Oktober 2021, S N3) hat Omar Bartov in seiner Kritik an Dirk Moses darauf hingewiesen, dass die grundlegende Definition des Völkermords durch die Vereinten Nationen im Jahre 1948 einen schwerwiegenden Geburtsfehler enthielt.
Die Tötung sollte nur dann international als Delikt verfolgt werden, wenn sie „…in der Absicht begangen wird, eine nationale, ethnische, rassische oder religiöse Gruppe als solche ganz oder teilweise zu zerstören“.
In diesem Text der Vereinten Nationen fehlten, so Bartov, bei der Aufzählung der die Tötung zum Völkermord qualifizierenden subjektiven Tatbestandsmerkmale die „politischen“ Absichten. Auf einer daraus folgenden Verengung der Definition hätten vor allem die Großmächte bestanden, die verhindern wollten, dass ihre eigenen politischen Repräsentanten und Angehörigen ihrer Streitkräfte unter das Verdikt fielen, wenn sie doch nur „für ihre Sicherheit“ getötet hatten. Es blieb dann ihnen allein überlassen zu definieren, welche missliebigen Gruppen sie als sicherheitsgefährdende Feinde betrachten wollten.
Nun wird man auch ohne Durchforstung der VN-Archive unterstellen können, dass dies nicht nur „die Großmächte“ so wollten, sondern dass dies fast allen beteiligten „Regierungen“ recht war. Die VN-Charta hatte ja gerade erst die einzelstaatliche Souveränität aller ihrer Mitglieder bekräftigt.“

For now, modern scientists are left either to believe what ancient records and village memory have to say about seemingly unbelievable lifespans, or to consider the accounts exaggerations, symbolism, or misunderstandings. For many, it’s simply a matter of faith.“
