I was arrested in March 2002 for the crime of unauthorised access, which at that time carried a maximum penalty of six months’ imprisonment. The American and British authorities delayed any criminal proceedings seemingly so that they had time to bring in the US-UK extradition treaty, which seemed almost tailor-made for my case and others like it. This treaty was drawn up (in American spelling …) in 2003, but not ratified by the US until 2006. Despite this some people (including the NatWest Three) were extradited under it prior to ratification.
All the US had to do was accuse someone of something and that was that. This couldn’t happen to a US citizen under the same treaty, since they are afforded the protection of their constitution.
We were told there was no evidence of the alleged damage, and yet we still had to fight against these accusations. When a case like that goes on for years it wears you down more and more on a daily basis. My life was on hold, as I sank ever deeper into depression. Then, one day in 2008, things started to change.“

Der Systemadministrator wird beschuldigt, in den Jahren 2001 und 2002 in 97 Computer der US-Streitkräfte und der NASA eingedrungen zu sein. Das Rechnernetz umfasste Computer der Army, Air Force und Navy des US-Verteidigungsministeriums und der NASA.
Disclosure Project – 9. Mai 2001 traten im National Press Club in Washington Zeugen aus Militär und zivilen Organisationen und berichteten von ihren Erfahrungen bezüglich UFOs und Geheimhaltung mit dem Ziel der Offenlegung der UFO-Geheimhaltung.
McKinnon gibt an, mithilfe eines selbst geschriebenen Perl-Skripts nach Rechnern ohne Passwort (blank password) gesucht und dann die Fernwartungssoftware pcAnywhere auf den Computern installiert zu haben. McKinnon hat die Tat bereits gestanden und behauptet, dass er in die Rechner nur eingedrungen sei, um Informationen über UFOs und außerirdische Technologie zu erlangen, wobei er angeblich auch fündig geworden ist.
Die US-Staatsanwaltschaft wirft Gary McKinnon vor, durch seine Tätigkeiten in den Rechnernetzen einen Schaden in der Höhe von bis zu 900.000 USD verursacht zu haben, und will ihn dafür in den USA vor Gericht stellen. Falls er in den Vereinigten Staaten verurteilt wird, erwartet ihn dort eine Strafe von bis zu 70 Jahren Haft und eine Geldstrafe von 1,75 Millionen USD.
Nachdem sein Einspruch gegen die Auslieferung an die USA in London am 3. April 2007 abgelehnt wurde, drohte ihm ein Prozess in den Vereinigten Staaten. Der Fall wurde im August 2008 vor dem Europäischen Gerichtshof für Menschenrechte behandelt, eine der letzten Chancen, um nicht in die USA ausgeliefert zu werden. Auch dieser Antrag wurde jedoch am 28. August 2008 abgelehnt. Letztendlich verlor er am 31. Juli 2009 auch einen Prozess am High Court und stand unmittelbar vor der Auslieferung. Im Jahr 2009 bekam er Unterstützung durch prominente Musiker wie Sting und andere. So hat David Gilmour, Gitarrist von Pink Floyd, den Rockklassiker Chicago von Crosby, Stills, Nash & Young mit dem Einverständnis von Komponist Graham Nash unter der Mitwirkung von Chrissie Hynde, Bob Geldof und Gary McKinnon selbst neu aufgenommen, um gegen die Auslieferung in die USA zu protestieren und diesen mit einem gleichzeitigen Spendenaufruf zu unterstützen.
Der Autismus-Experte Simon Baron-Cohen gab im Januar 2009 bekannt, dass er bei McKinnon das Asperger-Syndrom diagnostiziert habe. Seine Kollegen Thomas Bernie, Jeremy Turk und Declan Murphy schlossen sich dieser Auffassung an und warnten davor, dass eine Auslieferung McKinnon einer Suizid-Gefahr aussetzen würde.
Ende 2010 wurde im Zuge der Veröffentlichung von Depeschen US-amerikanischer Botschaften durch Wikileaks publik, dass sich der ehemalige Premierminister des Vereinigten Königreichs Gordon Brown für Gary McKinnon eingesetzt hatte.
Anfang 2012 äußerte das Oberste Zivilgericht Bedenken über die Dauer des Auslieferungsverfahren, das bereits zehn Jahre dauert.
Im März 2012 wurde das Auslieferungsabkommen zwischen den USA und dem Vereinigten Königreich erneut kritisiert und im Juni forderte der Abgeordnete David Burrowes den Premierminister David Cameron und den stellvertretenden Premierminister Nick Clegg auf, das Auslieferungsverfahren gegen Gary McKinnon zu beenden.
Im Oktober 2012 wurde das Auslieferungsbegehren der US-Justiz endgültig von der Innenministerin Theresa May abgewiesen.

„SUPPORTERS of the autistic British computer hacker Gary McKinnon are rallying support for the man who is fighting extradition to the US to face federal charges for penetrating dozens of government computers.
His family and supporters are taking the case to the newly formed Supreme Court, which replaces the House of Lords as the highest appeal court in Britain. If that fails, they will appeal to the European Court of Human Rights, a supporter said.
Sitting in his bedroom in north London shortly after the September 11 terrorist attacks, Mr McKinnon exploited security problems in a variety of computer programs to tap into dozens of US government computers, including at NASA, the Pentagon and more than a dozen military installations in 14 states.
Paul McNulty, the then-US Attorney for the Eastern District of Virginia, called it the “the biggest hack of military computers ever detected“.
Mr McKinnon was indicted in Virginia and New Jersey in November 2002 on eight counts of computer fraud. He explained his actions by saying he was looking for UFOs. But he has yet to be brought to the US.
In February, British authorities refused to charge him or have the US charges heard in Britain. The Crown Prosecution Service said it would be best to prosecute Mr McKinnon in the US and that his actions were not “random experiments“ but “a deliberate effort to breach US defense systems at a critical time which caused well documented damage.“
Mr McKinnon has admitted to hacking into 97 US government computers between February 2001 and March 2002.
His supporters argue that he should not be extradited to face the US charges because he has Asperger’s syndrome, a form of autism that he was diagnosed with last year. They say the diagnosis explains his obsession with hacking.
Rather than being America’s worst cyber-terrorist, his family says, he is a vulnerable eccentric who could become suicidal if removed from his family.“
